Terms of Service

Welcome to mindmap.io. Your use of our services, including the website at mindmap.io and all related applications and services (collectively, the "Service"), is governed by these Terms of Service (the "Terms"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

ARBITRATION NOTICE: EXCEPT FOR CERTAIN TYPES OF DISPUTES DESCRIBED IN THE ARBITRATION SECTION BELOW, YOU AGREE THAT DISPUTES BETWEEN YOU AND MINDMAP.IO WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 (or the age of majority in your jurisdiction), your parent or guardian must agree to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

2. Accounts

You must provide a valid email address to create an account.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You agree to provide accurate information and keep it current.
You must notify us immediately at [email protected] if you become aware of any unauthorized use of your account.
One person or legal entity may not maintain more than one free account.

3. Description of Service

mindmap.io is a web-based application for creating mindmaps and AI prompt maps ("PromptMaps") where every node is a prompt-response conversation turn. The Service uses third-party AI models to generate responses based on your prompts and conversation context. The Service offers free and paid subscription tiers with varying feature access.

4. Subscriptions and Payments

Paid plans are billed monthly via Stripe. By subscribing, you also agree to Stripe's Terms of Service.
Subscriptions automatically renew unless cancelled before the end of the current billing period.
You can cancel your subscription at any time. Access continues until the end of the current billing period. No refunds are issued for partial billing periods unless required by law.
We reserve the right to change pricing with 30 days' notice. Existing subscriptions are honored at their current price until the next renewal after the notice period.
If your payment method fails or becomes invalid, we may suspend access to paid features until payment is resolved.

5. Your Content

You retain full ownership of the mindmaps, prompt maps, and all content you create on mindmap.io ("User Content").
You grant us a worldwide, royalty-free, non-exclusive license to store, process, transmit, and display your User Content solely for the purpose of providing the Service to you.
You represent that you have all necessary rights to your User Content and that it does not infringe any third-party rights.
You are solely responsible for the content you create, upload, and share through the Service.
You can export or delete your User Content at any time.
User Content that is deleted may be irretrievable. We are not responsible for backing up your content beyond what the Service provides.

6. AI Features and Limitations

The Service includes AI features that generate text responses using third-party AI models. By using these features, you acknowledge and agree:

Your prompts and conversation context are sent to the AI provider that serves your selected model (Anthropic, OpenAI, Google Gemini, or xAI). Each provider has its own terms and data handling policies.

AI-GENERATED RESPONSES ARE PROVIDED "AS IS." WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, RELIABILITY, OR SUITABILITY OF AI-GENERATED CONTENT. AI OUTPUTS MAY CONTAIN ERRORS, INACCURACIES, BIASED CONTENT, OR MISLEADING INFORMATION. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING AND BEARING ALL RISKS ASSOCIATED WITH THE USE OF AI-GENERATED CONTENT. DO NOT RELY ON AI-GENERATED CONTENT AS A SOLE SOURCE OF TRUTH FOR ANY DECISION.

7. AI Model Training

We do not use your User Content (including prompts, responses, mindmaps, or any data you create within the Service) to train AI models, nor do we permit third parties to use your User Content for AI model training. Your content is used solely to provide the Service to you.

8. Intellectual Property

mindmap.io and its operators own all rights, title, and interest in the Service, including all software, design, branding, and documentation. These Terms do not grant you any rights to our trademarks, logos, or brand features.
You may not copy, modify, create derivative works of, reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
You may not use the Service to develop or train a product or service that is competitive with mindmap.io.

9. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
Upload, transmit, or distribute content that is illegal, infringing, defamatory, obscene, threatening, or harmful.
Attempt to gain unauthorized access to the Service, other accounts, or related systems and networks.
Interfere with or disrupt the integrity or performance of the Service.
Use any automated means (robots, scrapers, spiders) to access or extract data from the Service.
Use the Service to generate content that violates the terms of the underlying AI providers.
Resell, sublicense, rent, lease, or provide access to the Service to third parties without written permission.
Access the Service for the purpose of building a competitive product or service.
Transmit malware, viruses, or any code designed to disrupt, damage, or limit the functionality of the Service.

10. Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us an unrestricted, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback without compensation or attribution to you.

11. Third-Party Services

The Service may integrate with or link to third-party services (AI providers, payment processors, authentication providers). We do not control and are not responsible for third-party services. Your use of third-party services is governed by their respective terms and privacy policies. We make no warranties or representations regarding any third-party services.

12. Service Modifications

We may modify, update, or discontinue any part of the Service at any time without prior notice. This includes adding or removing features, changing usage limits, and updating interfaces. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Availability

We strive to keep mindmap.io available at all times but do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. Support is provided via email at [email protected].

14. Termination

You may terminate your account at any time by deleting it through the Service or contacting us. No refunds are issued for unused portions of a billing period.
We may suspend or terminate your access at any time for violation of these Terms, with or without notice.
If we terminate your account for reasons other than a Terms violation, we will endeavor to provide reasonable opportunity to export your data.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including ownership, warranty disclaimers, indemnification, and liability limitations) will survive.

15. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDMAP.IO AND ITS OPERATORS, AFFILIATES, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT OR DATA WILL BE ACCURATE OR COMPLETE.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINDMAP.IO AND ITS OPERATORS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THESE LIMITATIONS ARE ESSENTIAL TO THESE TERMS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

17. Indemnification

You agree to defend, hold harmless, and indemnify mindmap.io and its operators, affiliates, officers, agents, and employees from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law or third-party rights.

18. Copyright Policy

We respect intellectual property rights and expect our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to notices of alleged copyright infringement. If you believe content on the Service infringes your copyright, send a DMCA notice to [email protected] with the following:

Identification of the copyrighted work you claim has been infringed.
Identification of the material you claim is infringing and its location on the Service.
Your contact information (name, address, email, phone number).
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Your physical or electronic signature.

19. Dispute Resolution and Arbitration

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.

Any dispute or claim arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered under the rules of the American Arbitration Association (AAA). Arbitration shall take place in San Francisco, California, or at a mutually agreed location. The arbitrator's decision shall be final and binding.

Opt-out: You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice to [email protected] with your name and a clear statement that you wish to opt out of binding arbitration.

CLASS ACTION WAIVER: ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST MINDMAP.IO ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

For claims that are not subject to arbitration, the exclusive jurisdiction and venue shall be the state and federal courts located in San Francisco, California.

20. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

21. Miscellaneous

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and mindmap.io regarding the Service.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Electronic communications: By using the Service, you consent to receiving electronic communications from us (emails regarding your account, security, and the Service). These communications are part of your relationship with us.
